Helms originally indicted for criminal libel. On 31 July 1934 he circulated a "printed pamphlet" in which he stated that J. M. Gouge was an ex-thief. According to the allegations Gouge & a Dock Davis were the heads of a gang of thieves who operated in Mitchell Co., NC. Gouge a Justice of the Peace & magistrate. At one time Gouge & Helms ran against one another for the office of magistrate, with Gouge the victor.
