Bearden had brought suit against Fadlock for trespass in previous suit, which was dismissed and Court ruled in favor of Fadlock. Hudnall's name was listed as a security for costs of prosecution bond, but Hudnall charged that Bearden never asked him to be security nor had he ever been Bearden's security. Hudnall claimed he was not liable for any costs of trespass suit and wanted an injunction to prohibit collection of judgment from him.
