The defendant was one of many stock holders in the German Bank of Worster, Ohio. Around 1841 the bank suspended the use of specie pay. The legislature of OH wanted the charter of the bank revoked which prevented the bank from collecting dues until its investors became insolvent. Mr. Karthouse purchased the liability notes, himself insolvent, and was accused of doing so to defraud Bentley. Bentley sued to recover his investment.
