John Farr sued for a divorce from his wife Audrey. They had only been married for 5 years when he suspected her being with other men. She admitted to having intercourse with George Jackson and stated that he was the father of her youngest child. Plaintiff suing for custody of the other 2 children and for defendant to be restrained from selling or disposing of the household goods and furniture.

Allen sued Kirk for $209.25 debt by contract for drilling a well on defendant's land (139.5 feet deep for $1.50 per foot) and $19 for gasoline.

Origin of damages: car accident.

Railway sprayed its right of way w/poison & Blytha's mule ate poisoned grass on the right of way and died, so Blytha sued the railway. Blytha leased farm between railway & Walden's Ridge, near Elverton, & was working mule in cane mill during day, leaving it tied up 1/4 mile from railway at night. He drove schoolbus in morning. When he returned, his employee Chester Lee Johnson told him mule had broken rope & eaten poisoned grass. Exhibit: sign warning of poison/passable injury to livestock.

"a plea of trespass with force and arms to his damage one thousand dollars." Incident of 12 Aug. 1833, "with force & arms made an assault upon the person of said plaintiff .. In the county & state aforesaid and then with his fist, a rock & some other weapon, gave & struck the said plaintiff a very violent blow & stroke on the front part of the head thereby falling & knocking the said plaintiff down to & upon the floor .."

In original case, Dr. J. M. Thoburn provided medical services to a railway employee named Swicegood, who worked as a laborer at the Emory Gap section. He was injured at the Oakdale junction when he was run over by a train. Case contains interesting details related to medical treatment of railway workers.

Walker sued the City of Crossville for $10,000 damages for negligently causing him to be injured (he was struck by a car) while working (he was moving a pipe into a ditch) for said city on East Alley. Plaintiff charged that city should have blocked off the street and allowed traffic to detour around or at least put up signs warning traffic to slow down. Walker suing defendant for not providing a safe place to work.

Plaintiff was injured when floor of apartment fell in, due to actions by defendant. Add. Plaintiff: Dora Hassler.

Pla. was examining the railroad tracks of the Def. when a train came & stopped between where he was examining the tracks, his automobile on the other side. Familiar with railroad operating procedures, he decided that the train would blow a whistle before moving. Believing this the plaintiff began climbing between the train cars to reach the other side. The train suddenly began moving and threw him to the ground. The train ran over his legs, severing both. Case file includes map. See box 1537 for more.

Plaintiff is sued to recover a Plymouth Sedan Automobile, allegedly unlawfully seized and detained by the defendant.

Plaintiff sued Moore for $10,000 damages, charging him with failing to keep his promise to marry her. Plaintiff previously married, divorced 25 Sept. 1933. Had a daughter named Alberta Ruth, dec. 10 May 1935; stated that Albert Moore was the child's father. Letters in back of folder; originally on Pp. 74-78. 2 Folders.

Plaintiff charged that the defendant was planning to fraudulently dispose of property to avoid a previous judgment made against him for a debt owed to the plaintiff. Plaintiff is sued for damages in the sum of $25,000.

Mary S. Byrd, the wife of R.K. Byrd was arrested by Yost, a Confederate soldier. Byrd accuses Yost of falsely imprisoning her for 30 days. The papers contain a written transcript of a letter sent from R.K. Byrd to Mary Byrd during the Civil War, when he was a Federal soldier stationed in Kentucky.

Plaintiff company is comprised of William T. Johnson and John Coleman. sued for an act of trespass on the case for damages done for a sum under $250.
