Mary S. Byrd, the wife of R.K. Byrd was arrested by Yost, a Confederate soldier. Byrd accuses Yost of falsely imprisoning her for 30 days. The papers contain a written transcript of a letter sent from R.K. Byrd to Mary Byrd during the Civil War, when he was a Federal soldier stationed in Kentucky.

The plaintiff in error is accused of falsely arresting and imprisoning the defendant for 150 days. The plaintiff argues that the defendant was a Federal soldier during the Civil War and that it was then legal for him to be arrested. The defendant argues that he had been a soldier but had resigned prior to his arrest.

Plaintiff sought to recover $500 damages for trespass. This stems from an agreement that plaintiff would rent a farm to defendant, with 250 bushels of good 'merchandisable' corn due as rent. Non-payment of this obligation resulted in suit.

Byrd claims the plaintiffs took possession of and destroyed two houses owned by he and his wife near the town of Kingston. One house was used as a schoolhouse where his wife taught. The schoolhouse was taken into possession by Kincaid's Company of Confederate soldiers and was used as a headquarters.
