In original case, Troy et al. were defendants and Sivley the plaintiff. Sivley's car was sitting in front of house when car owned by Troy recklessly and negligently ran into a milk wagon and knocking wagon into her car (Detroit Electric), damaging it. Sivley sued Troy and had received judgment for $300. Troy moved for new trial, which was refused, and later moves to dismiss attachment in the Court of Civil Appeals. |

King sued Smythes for $10,000 in damages for negligent and reckless driving. Smythes ran their car over and against King's car, throwing him to the ground and inflicting severe and permanent injuries. This case grows out of same car accident described in B.M. Roddy v.
