Incomplete case.

Defendant recovered a judgment against the plaintiff in March 1876 for $785 and he has not paid and therefore the Constable was going to sell his property to be the debt unless restrained by the court.

Defendant is the administrator of the estate of his father W. F. Karnes (dec.), who is also the father of D. P. Butler. In 1909, the plaintiff purchased from W. F. Karnes a tract of land for $600, paying $100 in cash and the balance in five deferred pay- ments. Prior to his death, the plaintiffs paid $500 and also bought the homestead from the other heirs. The defendant as administrator told the plaintiffs they owed more money for the land and therefore owed the heirs more than they were paid.

Case involves a dispute over $337 and costs of suit executions were issued upon judgment to the Sheriff of Morgan county levied on land orders of sale issued and the land sold for nominal amount failing to satisfy the judgment and execution.

John Capps leased a track of land from defendant for a term of 10 years. When defendant in possession of land & refused to turn it over, plaintiff sued for possession rights and cost of suit. Note hand drawn map of tract in dispute on page 43.

Fannie (F.A.) sued for her right of ownership to 1/2 of the property willed to her by her father, as the city is looking pay land holders for widening the street and making other improvements on the property.

Case deals with claim against the United States government for property destroyed by the Federal forces during the Civil War. Property that was destroyed belonged to Caleb R. Clement, deceased. His daughter and heir Rebecca Clement, deceased, was married to defendant, T. H. Lewis.
