Eckel took out a mortgage on land payable to W. L. Jack, C. B. Johnson was the trustee. Jack acted as agent for S. R. Rambo. Hahn purchased the mortgage note from her brother, John M. Ross.The mortgage was foreclosed upon, & Hahn sought payment, or title. The land had been conveyed to C. C. Rutherford & his wife in the mean time. Suit sought to recover debt & clarify land ownership.

Neal wishes to cancel a mortgage on the grounds that it was overpaid when he was the borrower from New Orleans Loan, Building, and Savings Association. When that institution went into liquidation it transferred the mortgage to the defendant. The new loan was under the guise of a new loan. All payments to the original loan should be credited to this loan which has been dealt with.

Additional Complainants: Polly Lillard, R. F. Whitson, F. J. Oates, Susan Oates, formerly Susan Stanley. Additional Defendants: Charley Whitson, J. H. Davis. The bill was filed to have a guardian appointed to defendant minors and to foreclose a mortgage with defendant Davis.

Plaintiff loaned Defendants money, securing the note with a mortgage against Defendants' 70-acre tract of land, which land Defendants had purchased from Milton Pollard's heirs. Note also secured by 2-horse wagon & harness & 3 horses. Horses included 8-yr old bay mare, 10-yr old sorrel horse, 8-yr old gray horse. Plaintiff says Defendants paid part of note from proceeds of tobacco crop, but they have not paid the balance & he wishes to have the land sold to pay the debt.

Plaintiffs: Frank Smith and wife, Mary Smith. Defendants: W. H. Bond; R. D. Farrow and wife, Lutie Bond Farrow- both residents of Ky. This file deals with pre-existing debt in regard to mortgage to be raised, a disparity in the price of the properties, the value of the properties. Mortgage due the Building & Loan Co., $387.35 with a years interest. "in the case at bar we have illiterate negroes dealing with smart, smooth white people." (p. 96). Properties located near Ayers St., Lane Ave., Memphis.

George W. McNutt was a constable in Hickman County. Depositions were given by James Young, James Mayfield, and Jeremiah Gibson.

M. S. Hawkins is administrator of the estate of Elizabeth Hawkins. Additional defendants: Irene Martin and James T. Martin.

Additional defendants: Archibald Rodgers, E. L. Gardenshire, all citizens of White County Tennessee, and the President and Directors of the Sparta branch of the Bank of Tennessee. Involves slaves, named Austin, Becky, Charlotte, Jourd, Mariah Crockett, slaves continued: Martha, Nathan Charles and Rose.

Add'l defs: Samuel Douglass, Mrs. Ida, Felicia A., Ann, Mary, Nancy, Thomas, Irving, & Tennessee Stack, Eli Harris. Stack & his brother G. W. bought land together in Chatham County for $1000, one third of which was paid with cash. However,the remainder of the debt was never paid. The boundaries of the land were later disputed.

Plaintiff's wife: Lucy Smith. Plaintiff was indebted to def. in May 1887 for ~$650, in merchandise, shoes & boots to sell over time. Def. claims Plaintiff used a Capt. W.D. Taylors name in his business to acquire and sell goods under false pretenses. This led def. to take out a mortgage on plaintiffs land, which they signed under threat of criminal prosecution. Plaintiffs are suing for relief, claiming they had an understanding w/Capt. Taylor and only signed the mortgage under duress.

Add. plaintiff: William A. Hamilton. Add. defendants: R.W. Turner, Mrs. Mary F. Hamilton, & Mrs. Sarah A. Hamilton. In 1864, one A. Hamilton executed to the plaintiff as Trustee two tracts of land and later W.A. Hamilton executed to defendant Sarah A. Hamilton, then Owen, a mortgage on one of the tracts for $500. Plaintiffs charge that the full amount of the note and mortgage has yet to be paid.

Additional Defendant: W. S. Garrett. Plaintiff sued by husband & next friend, J. B. Parrent. In 1894 plaintiff made bill of sale to Bailey for hardware store that was part of her separate estate, using store as security for $2906.65 owed to Bailey. When debt not paid in specified time Bailey took possession of store & its goods & denied them access. Plaintiff maintains this is unlawful as store part of her separate estate.
