Annie Lee Harwood claims that Milne was driving negligently at great speed and was driving said in such a manner as to have no control thereof and was not keeping a lookout ahead as required by law and the result was a collision with plaintiff's car. Defendants originally won judgment of $250 plus costs against plaintiff in 1905. Plaintiff appealed decision; in 1906 judgment affirmed when plaintiff defaulted. Plaintiff seeks new appeal, maintains that the earlier default was caused only by the failure of plaintiff's counsel to arrive on time. Nature of original lawsuit not stated.

This suit was instituted to recover on a policy of fire insurance issued by the defendant and also to recover penalties for the wilful, malicious and flagrant failure to pay said policy. Assignments of error present for a review by this court include: that the policy was secured by means of false and fraudulent representations, that he failed to give written notice of loss within sixty days and that the conduct of the plaintiff was such as to justify the recovery of the penalty provided by statute.
