Yearwood sued to recover two thirds of a lot of cotton consisting of about five hundred pounds of seed. This cotton belonged to Yearwood, and ended up in the possession of John Wade, who seized it from the Sheriff of Rutherford County. Collier had levied the cotton on a debt, but only owned one third of it. |
