The impact of the collision hurled the plaintiff over a fence and prostrate, to the ground- rendering him unconscious until the next day. |

Defendant is the administrator of the estate of his father W. F. Karnes (dec.), who is also the father of D. P. Butler. In 1909, the plaintiff purchased from W. F. Karnes a tract of land for $600, paying $100 in cash and the balance in five deferred pay- ments. Prior to his death, the plaintiffs paid $500 and also bought the homestead from the other heirs. The defendant as administrator told the plaintiffs they owed more money for the land and therefore owed the heirs more than they were paid. |

The car contained 1008 crates of tomatoes. When the plaintiffs deposited Hale and Warmath is a partnership composed of H. P. Hale and J. P. Warmath the check for the shipment of tomatoes at the Bank of Gibson, they were notified 2 or three days later that the check would not be paid due to lack of funds. |
