Chap. 764 of Private Acts of 1933 states that no Justice of the Peace may teach in a public school with a population of less than 14,070. Lewallen, and Clark Lewallen were both JPs and told by the school board they were no longer welcome to teach. Plaintiffs argue this Act to be discriminatory, arbitrary, and unconstitutional.
