Appeal case. Waller was the Secretary on the County Board of Election Commissioners. Both Waller and Smith ran for Justice of the Peace. Smith is accusing Waller of illegally paying poll taxes for various and divers voters of the district so that he would win the election.

Plaintiff is a Cherokee Indian, who is sued to retain land ceded to him by the Cherokee Treaty of 1819. Add. defendant: Gilliland.

Add. plaintiff: R.A. Brown & John Den. Plaintiffs contracted a tract of land to a said Den for ten years. However, Ellis states that a majority of the property was theirs and forcefully ejected Den from his property. Filed for damages of $500.

Winston owned 65 acres on Big Poplar Creek & Big Indian Creek, to which both Winston & defs claimed title. Add. defs: Charles M. McGhee, Barclay McGhee, J.W.J. Niles & wife Margaret W. Niles (added selves as defs claiming title to land in dispute). Jury ruled in favor of defendants.

This case concerns the ejectment for the recovery of 640 acres of land in Roane County claimed as Reservation under the Calhoun Treaty. This area was known as Blair's Ferry after the defendant. Pathkiller was the last hereditary chief of the Cherokee, and a colonel under Andrew Jackson in the Creek War. See other cases in ET 1627 relating to this case.

Involves the Brittain Goodwin estate. Several slaves mentioned by name: Lucy, Liddy, Jack (a "good stout boy"), Elijah, Sophy, Harry, Eleck, Winny, Dinah, Lidda, Beverly [?], George, and Lige. Some slave values stated. In one passage, it is noted that Bell believed he had the right to do w/his wife's property as he pleased. Page is missing.

Underwood sued the Singer Corp. for violation of a conditional sales contract.

Defendants are the administrators of the estate of Samuel Bennett (dec.). Issue of missing taxes from the deceased's estate for the year of 1865.

Fritts sued Huff for taking & detaining his 5-year-old iron gray horse mule. Jury ruled in Fritts' favor & awarded him $2 for such detention. Witness John H. Eldridge said he was returning from the post office & passed Carter's Mill when Fritts rode up & then Frnak Waddell came by riding a mule branded "U.S. & J.C." After some conversation (including a look at the mule's papers), Fritt traded with Waddell for the mule. Mule later taken. Fritts' dad John Fritts also testified.
