J. M. Elder was an employee of Dayton Coal and Iron. On July 13, 1885 he was directed to be elevated on a platform or hoist which was raised and lowered by means of rope pulleys and a hook. In carrying out his duties as an employee, he was elevated perpendicularly about 70 ft. when due to gross negligence of construction of platform and its fastenings, the platform detached from its fastenings fell 70 feet. The plaintiff suffered severe bodily injuries, in much pain. Damages: $5000 |

Cox, defendant's agent, without the plaintiff's knowledge or permission. Later, the house and contents were destroyed by a fire, and the defendant gave benefits to Newberry. |
